The Supreme Court has affirmed Ademola Adeleke of the People’s Democratic Party (PDP) as governor of Osun State.
In a judgment prepared and delivered by Justice Emmanuel Agim, the Tribunal dismissed the appeal of Gboyega Oyetola of the All Progressives Congress (APC) for lacking in merit.
The apex Court dismissed the appeal faulting the Court of Appeal decision of 24 March which upturned the decision of the Tribunal that nullified the July 16 Osun Governorship election result.
In an unanimous decision, the court maintained that Oyetola failed to prove its case of improper accreditation and over-voting.
“The Electoral Act have not abolished the voter register, and that whenever there is a case of over-voting there is need for the voter register and the Bimodal Voter Accreditation System (BVAS) to prove so,” Agim said.
The Apex Court also stated that the BVAS of the 744 disputed polling units needed to have been provided to prove the case
